Terms & Conditions
Herde Care helps a community gather around someone in the middle of a life event and turn care into concrete, time-slotted help. These terms explain how the app works, what we ask of you when you use it, and the limits of what we can be responsible for. Please read them — using Herde Care means you agree to them.
Accepting these terms
Herde Care is operated by Herde LLC — Colorado, USA. When you create an account or otherwise use the app, you agree to these Terms & Conditions and to our Privacy Policy. If you don’t agree with them, please don’t use Herde Care.
A quick note on the words we use: the app is Herde Care. A Herde is the support group you build inside it around one person — the beneficiary — going through something. The person who creates and administers a Herde is its owner; anyone who joins to lend a hand is a member. Owners and beneficiaries together are the admins of a Herde.
Eligibility & your account
To use Herde Care you must be able to form a binding agreement with us, and you must be at least 13 years old. Herde Care is not directed at children under 13, and we don’t knowingly collect information from them.
When you sign up, please give accurate information and keep it current. Your account is yours to look after: keep your login details private and let us know promptly if you believe someone else has gained access to it. You’re responsible for what happens under your account.
Acceptable use
Herde Care exists to coordinate genuine community care. Use it in that spirit. In particular, please don’t:
harass, threaten, abuse, or intimidate anyone you meet through a Herde;
impersonate another person, or misrepresent who you are or your connection to a beneficiary;
send spam, or use the app to advertise or solicit;
misuse the personal information of other members — the contact details, whereabouts, and circumstances you learn inside a Herde are shared with you in confidence;
use Herde Care for anything unlawful, or to help anyone else do so.
A Herde brings you into someone’s private life at a tender moment. Treat the people and the information you find there with the care you’d want extended to your own.
Real-world help between members
This is the most important thing to understand about Herde Care, so we’ll say it plainly.
Herde Care is a coordination tool. When a member volunteers to bring a meal, run to the store, cover an errand, or lend other caregiving-adjacent help, that commitment is between the community members involved. Herde Care and Herde LLC are not a party to it. We don’t vet, screen, supervise, employ, endorse, or guarantee any member, and we are not responsible or liable for what any member does or fails to do — including whether help actually shows up, the quality or safety of that help, or anything that happens in any interaction between members. You arrange and accept real-world help at your own discretion and risk, and you’re expected to use good judgment about who you rely on and who you help.
Herde Care is also not a healthcare, medical, emergency, or professional caregiving service, and nothing in the app is professional, medical, or legal advice. If someone is in danger or needs urgent help, contact your local emergency services — don’t rely on Herde Care.
Your content
You’re responsible for the content you add to a Herde — its name and description, the tasks and time slots you set up, and anything else you write. Make sure you have the right to share it, and that it doesn’t violate these terms or anyone else’s rights.
You keep ownership of your content. To run the service, you grant Herde LLC the limited license we need to store your content and display it to the relevant members of your Herde. Herdes are closed, invite-gated groups — we don’t make your Herde content public, and this license exists only so the app can do its job.
Availability of the service
We offer Herde Care on an “as is” and “as available” basis. We’re a small operation, and from time to time we may change, add, remove, suspend, or discontinue features — or the whole service — as the app grows and evolves. We’ll try not to disrupt you needlessly, but we can’t promise the app will always be available or free of interruptions.
Warranties & liability
To the fullest extent permitted by law, Herde Care is provided without warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the app will meet your needs, be uninterrupted, or be error-free.
TO THE FULLEST EXTENT PERMITTED BY LAW, HERDE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF HERD CARE.
Put more simply: Herde Care is a tool for organizing help, and there are limits to what we can answer for. Some places don’t allow certain limitations of liability, so parts of this section may not apply to you; where that’s the case, our liability is limited to the smallest amount the law allows.
Ending your use
You can stop using Herde Care at any time. You can also delete your account and its data whenever you like, straight from the app — go to Profile → Delete Account. If you own any herdes, deleting your account removes them and everything in them, so let your members know first if that matters.
We may suspend or close an account that breaks these terms or puts other members at risk. Where it’s reasonable to do so, we’ll try to let you know why.
Changes to these terms
As Herde Care grows, we may update these terms. When we do, we’ll revise the “Last updated” date at the top of this page. If you keep using the app after a change takes effect, that means you accept the updated terms. If you don’t agree with an update, please stop using Herde Care and, if you’d like, delete your account.
Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules.
